3. Where We Get Personal Information

  • From you, when you place an order, create an account, contact us, submit a review, enter a promotion, or sign up for emails or texts.
  • Automatically, through cookies, pixels, tags, software development kits, session-recording tools, and similar technologies when you use the Site or open our emails.
  • From service providers and partners, such as our e-commerce platform, payment processors, shipping carriers, review platforms, marketing platforms, affiliates and creators, and marketplaces such as TikTok Shop when you buy from us there.
  • From advertising and social media platforms, when you interact with our ads or social media pages.

4. How We Use Personal Information

  • To process, ship, and deliver orders, handle returns and warranty claims, and provide customer support.
  • To operate, maintain, secure, and improve the Site and our products, including debugging, testing site features, layouts, and prices, and analyzing how visitors use the Site.
  • To send transactional messages, such as order confirmations and shipping updates.
  • To send marketing emails and, with your consent, marketing text messages, and to run promotions, loyalty, referral, and affiliate programs.
  • To show you personalized advertising on other websites and platforms and to measure how well our ads perform.
  • To detect, prevent, and respond to fraud, chargebacks, abuse, security incidents, and illegal activity.
  • To comply with law, enforce our Terms of Service, and establish or defend legal claims.
  • For any other purpose we describe to you when we collect the information, or with your consent.

We do not use or sell personal information to train large language models.

5. How We Disclose Personal Information

We disclose personal information to the following categories of recipients:

  • Service providers and contractors that work on our behalf and are contractually restricted from using your information for other purposes. These include e-commerce hosting (Shopify), payment processing, order fulfillment and warehousing, shipping carriers, customer support tools, email and SMS platforms (such as Klaviyo and Recart), review platforms (such as Judge.me), analytics and site-testing tools, and cloud storage. We disclose identifiers, customer records, commercial information, internet activity, approximate geolocation, audio/visual information, and inferences to them.
  • Advertising and analytics partners, such as Meta (Facebook and Instagram), Google, TikTok, Snapchat, Microsoft (Bing and Clarity), and X, through cookies, pixels, and similar tools on our Site. These partners may use information about your activity (identifiers, internet activity, commercial information, approximate geolocation, and inferences) for their own purposes, including to show you ads across other sites and services. Under some state laws, this may be considered a "sale" of personal information or "sharing" for cross-context behavioral advertising, or "targeted advertising." See Section 8 to opt out.
  • Affiliates, creators, and marketplaces, such as TikTok Shop and our affiliate partners, to process orders placed through them and to credit and pay commissions.
  • Legal and safety recipients, such as courts, law enforcement, regulators, or other parties, when we believe disclosure is required by law or needed to protect our rights, property, or safety, or those of our customers or others.
  • Business transfers. A buyer or successor, in connection with a merger, acquisition, financing, or sale of all or part of our business or assets.
  • With your consent or at your direction.

We do not sell personal information for money. We do not sell or share the personal information of consumers we know are under 18.

6. Cookies, Pixels, and Session Recording

We and our partners use cookies, pixels, tags, local storage, and similar technologies to:

  • make the Site work, such as keeping items in your cart;
  • remember your preferences;
  • understand how visitors use the Site; and
  • deliver and measure advertising.

Some of these tools, including Microsoft Clarity, record how you interact with the Site (for example, clicks, scrolling, mouse movements, and pages visited) so we can find and fix usability problems. We configure these tools to mask text you type into form fields, such as payment details. Where required, we ask for your consent before these tools run, and you can change your choice at any time through the cookie or privacy settings in the Site footer.

You can block or delete cookies in your browser settings, but parts of the Site may not work properly. You can also opt out of interest-based ads from many companies at optout.aboutads.info and optout.networkadvertising.org. For more detail, see our Cookie Policy.

Global Privacy Control. We treat a Global Privacy Control (GPC) signal from your browser as a valid request to opt out of the sale and sharing of your personal information and targeted advertising for that browser. We also apply it to any account or other identifiers we can link to that browser. When we detect a GPC signal, the Site will show that your opt-out request was honored in Your Privacy Choices.

Do Not Track. We do not respond to "Do Not Track" browser signals, because no common standard exists for them. We do honor GPC as described above.

7. Marketing Emails and Text Messages

You can unsubscribe from marketing emails at any time using the link in any email. We may still send you transactional messages about your orders.

If you opt in to our text messages, you can reply STOP to any message to opt out, or HELP for help. Message frequency varies. Message and data rates may apply. Consent to receive marketing texts is not a condition of purchase. Our Terms of Service contain our full messaging terms.

No mobile information will be sold or shared with third parties or affiliates for their own marketing or promotional purposes. Text-messaging opt-in data and consent are not shared with any third parties, except service providers that help us run our messaging program.

8. Your Privacy Rights

Depending on where you live, and to the extent required by applicable law, you have the rights listed below. We will honor these requests from any U.S. resident. We may decline a request where an exception applies.

  • Know and access. Confirm whether we process your personal information, and get the categories and specific pieces we hold, the sources, the purposes, and the categories of third parties we disclose it to.
  • Portability. Get a copy of your personal information in a portable format.
  • Correction. Correct inaccurate personal information.
  • Deletion. Delete personal information we collected from or about you.
  • Opt out. Opt out of the sale of your personal information, "sharing" for cross-context behavioral advertising, targeted advertising, and profiling that produces legal or similarly significant effects. We do not engage in that type of profiling.
  • List of third parties. Get a list of the specific third parties to which we have disclosed personal information, where state law provides this right.
  • Non-discrimination. We will not discriminate against you for exercising your rights. We may still offer different prices or benefits connected to our loyalty and promotional programs, as described in Section 9.

How to submit a request.

  • To opt out of sale, sharing, or targeted advertising: click the "Your Privacy Choices" link in the footer of our Site, turn on GPC in your browser, or email support@ventyfan.com with the subject line "Privacy Opt-Out."
  • For all other requests: email support@ventyfan.com with the subject line "Privacy Request."

Verification. For access, correction, and deletion requests, we will verify your identity by matching information you provide, such as your email address and a recent order number, against our records. We do not need to verify opt-out requests.

Authorized agents. You may use an authorized agent to submit a request for you. We may require written proof of the agent's authority and ask you to verify your identity directly with us.

Response timing. We will respond within 45 days. Where the law allows, we may extend this by another 45 days, and we will tell you if we do.

Appeals. If we deny your request, you may appeal by emailing support@ventyfan.com with the subject line "Privacy Appeal" within 60 days of our decision. We will respond within the time required by your state's law (generally 45 to 60 days). If you are not satisfied with the result, you may contact your state Attorney General.

9. Notice of Financial Incentive

We sometimes offer a discount, free gift, or other benefit when you sign up for our emails or texts, join a loyalty or referral program, or enter a promotion. Each offer's specific terms are shown when you sign up. Joining is voluntary, and you can withdraw at any time by unsubscribing or by contacting us.

We offer these incentives because subscribers' personal information lets us market to them directly. In good faith, we estimate the value of a subscriber's personal information to be about equal to the value of the incentive offered. We calculated this by comparing the average additional gross profit we earn from subscribers over 12 months, minus our program costs, with the cost of the incentives we give.

10. How Long We Keep Personal Information

  • Order, warranty, and transaction records: up to 7 years after the transaction, for tax, accounting, warranty, and legal purposes.
  • Account information: for as long as your account is open, and for a reasonable period afterward.
  • Marketing contact information: until you unsubscribe, plus a suppression record so we honor your choice.
  • Customer support communications: up to 3 years.
  • Site analytics and advertising data: generally up to 26 months.

We may keep information longer where required by law or needed to resolve disputes or enforce our agreements.

11. How We Protect Personal Information

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account password confidential.

12. Children and Teens

The Services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information from children under 13. We do not knowingly sell or share personal information of, or target advertising to, anyone under 18. If you believe a child has given us personal information, contact us and we will delete it.

13. State-Specific Disclosures

California. This policy serves as our notice at collection. In the preceding 12 months, we have sold or shared (as those terms are defined under California law) identifiers, internet or other electronic network activity, commercial information, approximate geolocation, and inferences with advertising and analytics partners, for cross-context behavioral advertising and analytics. We disclosed all of the categories in Section 2 to service providers and contractors for the business purposes described in Section 4. We do not use or disclose sensitive personal information for purposes that would give you the right to limit its use.

Under California Civil Code Section 1798.83 ("Shine the Light"), California residents may ask whether we disclosed personal information to third parties for their own direct marketing in the previous calendar year. We do not disclose personal information to third parties for their own direct marketing purposes, except as part of the advertising activity described above, which you can opt out of.

Nevada. We do not sell "covered information" for monetary consideration, as defined under NRS 603A. Nevada residents may still send an opt-out request to support@ventyfan.com.

Other states. Residents of Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, Virginia, and other states with consumer privacy laws may exercise the rights in Section 8.

14. Visitors Outside the United States

We are based in the United States, and your information will be processed in the U.S. and in other countries where our service providers operate. If you are in the European Economic Area, the United Kingdom, or another region with data protection laws:

  • We process your information to perform our contract with you, based on our legitimate interests (such as running and improving our business and preventing fraud), to comply with legal obligations, and, where required, with your consent (for example, for non-essential cookies and marketing).
  • You may have the right to access, correct, delete, restrict, or object to processing, to data portability, and to withdraw consent.
  • You may also lodge a complaint with your local data protection authority.
  • Where required, we rely on appropriate safeguards, such as standard contractual clauses, for international transfers.

15. Third-Party Sites and Platforms

The Site may link to or integrate with third-party websites and platforms, such as social networks, TikTok Shop, PayPal, and YouTube. Their privacy practices are governed by their own policies, not this one.

16. Changes to This Policy

We may update this policy from time to time. We will post the updated version with a new "Last updated" date. If we make material changes, we will provide additional notice as required by law.
